Auctions@Petz-Reloaded Terms of Service

At the moment we will provide Auctions@Petz-Reloaded as running Beta version.The system itself should run without any bigger problems.
But we are planning to inlcude some minor and major extensions into the running system step by step. This could result in sudden error messages,
random system failures, in malfunctions at some area(s) of the site. And especially in sudden offline phases of the whole Auctions site
for fixing errors or just implementing new features to it. Fixing errors and implementing of new features takes time, so please be patient if
something isn't working as expected.
Please keep in mind, this is a running beta version. So some of the rules can not be realized yet, because of technical purposes.

Introduction to the Terms of Service

Please read all of them carefully. You have to follow our Terms of Service in order to use our Service.

General Agreements

1. The Service

Auctions@Petz-Reloaded is a private, non-commercial, non-profit auction platform for worldwide petz gamers. We have the right to discontinue this service anytime without warning and without giving you any reason. We can take it offline for maintainance anytime, without announcement, if necessary.

2. Copyrights

Most scripts, graphics and website contents are copyrighted by Timeless-Games.com. The Simple Edit DHTML Control is copyrighted by Cezary Tomczak and was altered by Timeless-Games.com for Auctions@Petz-Reloaded's needs. Petz, Catz and Dogz are copyrighted by UBI Soft Entertainment Inc. The Auctions@Petz-Reloaded Forum is copyrighted by the phpBB Group. All other content is copyrighted by their respective owners.

3. Disclaimer

We are not responsible for any damage caused to your computer and or data stored on your computer by using this site or downloading anything from it.

Membership Agreements

1. Registering to Auctions@Petz-Reloaded
Your account is activated after you have clicked on the activation link in the confirmation e-mail we will send you within 18 hours after registration and entered your specific SUN number into our registration form. You will be directed to our registration form directly by clicking on the activation link in the email. With first login to your account you are binded to Auctions@Petz-Reloaded Terms of Service. Violating these Terms of Service will result in an immediately deactivation of your account without warning and without any chance to reactivate.

2. Limited Number of Accounts per Person
Only one account per person is allowed. If we encounter more than one account of one person, we immediately freeze all accounts of the specific person.

3. Registration closings
We can discontinue the possibility of new registrations if needed anytime regarding to the server's bandwith capacity or in cases of abusing Auctions@Petz-Reloaded by the members.

4. Privacy Protection
For registration we need your valid e-mail address. It will only be used for Auctions@Petz-Reloaded purposes. All data you entered are not given away to third. Make sure you use a valid email address for signing up at Petz-Auctions, because we will send your specific SUN number with the registration confirmation email and without a vailid email you have no chance to enter your SUN in our registration form and this means no Petz-Auctions account for you.

5. IP Logging
Evertime you log in to Auctions@Petz-Reloaded the server logs your IP-Address, Browser Data, Login Time and Site Hits for analysing and investigation purposes. When you log in the first time, you agree with these loggings. All data taken are not given away to third.

6. Deleting Accounts
The Administration of Auctions@Petz-Reloaded has the right to deactivate, temporary ban and freeze any account because of violating any of this Terms of Service or in case of abusing this platform. The Administration also can deactivate accounts because of reasons told to the account owner before if the situation deserves it.

 7. Causing trouble, unpoliteness, cheap propaganda

Anyone who is causing trouble, in our tagboard or elsewhere will be suspended from the service immediately by freezing your Petz-Auctions account. Anyone who is unpolite to the other members, uses rude wordings, insults others in our tagboard will be warned just ONE time. If the disbehaviour continues you will find your account frozen immediately, without any further warning.

  8. Suspending of member accounts

We reserve the right to freeze a member account without giving any reason when the situation demands it.

Selling Agreements

1. General
Every members is able to have 10 auctions running at the same time. The minimal auction time is 18 hours and the maximum time is 72 hours. Members which have sold 25 pets succesful are able to create auctions with a running time of 12 hours, members which have sold 50 pets succesful can start auctions with 10 hours duration.

2. Uploading the pet
The pet which is to be sold will be uploaded to our server. While uploading you agree, that some data of your pet will be collected. These data are the name of the pet, the birthdate, the race, gender and species, the name of the owner, the family tree (including owners and generations), the file size, the generation, the pedigree status and the fertility. Additional Auctions@Petz-Reloaded reads the picture of the pet. This is the picture which will be displayed in the buying overview screen and the description.
After uploading you can enter information about the need of extra files, where you got it from, the auction's duration, the starting price (between PC 1.00 and 5.00) and a description.
In the description you are not allowed to use rude language and insulting diction. For formatting text and inserting a picture, please use our built-in WYSIWYG (What you see is what you get) editor. It is not allowed to insert more than one picture. The picture has to belong to the pet. It's not allowed to post pictures of other pets, advertisement for your site, erotic or pornographic content or any other image which has nothing to do with your auction. We do not tolerate the following in the auction description: alcohol reference, drug reference, pornographic reference, rude or offending language or symbols, nazi reference. Please keep in mind, that also very young members are using this site. Auctions which violates these terms will be deleted immediately.

The Picture has to be an original picture of the pet. The PET seen on the picture must not be enhanced or modified by any photo/picture editing software.
If you use any hostile HTML-Tags, scripts or anything else, which can cause damage to Auctions@Petz-Reloaded or any computer of the members (like viruses, trojans, etc.) will be deleted immediately. Members accounts of people using such hostile code will be deactivated and reported to the police.

3. Allowance

You are definitely not allowed to sell

• pets already uploaded to PA by you (multiple copies)
  - stolen pets or pets from stolen breeds
  - pets already sold at PA by you

• - downloadable pets

- adopted/traded pets without permission of the pre-owner

- pets/breeds modified by you based on the work of another creator without permission of the original creator

- auctioned pets, if forbidden by the auction rules of the seller in the auction description

- pets adopted by the AAC without permission of the pre-owner

- pets already sold at the AAC or which you already have given away by any way (this means NO multiple copies all around the community)

- Updated: August,18th 2009 - 1st generation pets adopted straight the ingame adoption center
- Updated: May,19th 2005 - pets bred with breeds from an other creator without giving credit and/or without permission (if needed)
This encloses first generation (directly adopted) petz that are from a breed that is not directly provided with the game

Permission and Credit when you hex pets created from breedz which are not installed with your petz game directly

-         You have to give credit to the original creator by writing down the creator's name in the auction description (for example: Credit for the Breedfile goes directly to Java)

-         You have to provide a link to the creator’s website in your auction description, so the original breedfile can be downloaded when needed.

All types of pets not stated in the disallowance above are allowed to sell - preferably your own work.

The owners of this site cannot be made responsible for any uploaded content around the auction or stated in the tagboard.

You are responsible for the content (pets, pictures, texts, descriptions) you use yourself.

 If a seller violates any rule you can report this violation to our provided email address at the moment, later by using the „Report this Auction – Button“ and the situation will be clarified as soon as possible.

4. Regulations of other sites and webmasters
Every member is responsible for observing and FOLLOWING the rules of other sites and webmasters. We have no control over this rules and we are not able to check all of them out. Auctions which violate rules of other websites can ONLY be deleted by the seller on request of the particular website owner. The seller of the auction has to contact us to ask for auction deletion with given statement of the particular website owner.

5. Cancelling running auctions
No auctions can be cancelled at the moment. So please be careful what you want to sell and what you do while starting an auction.

6. When an auction was unsuccessful
When you did not sold a pet, it will stay 2 days on the server before it will be deleted from the server automatically. You have to upload the particular pet to our server again, if you want to try the auctioning of it again.

7. Relisting a Pet
Relisting a pet is not available at the moment.

8. Editing Pet's Description
Editing the description is not available at the moment.

9. Seller’s own Rules

If a seller wants to sell under specific conditions (i.e. no re-selling allowed, etc.) it has to be public visible in the pet’s auction description, in a normal font size and color, so everyone can read and understand it. It is not enough to put such rules only into the pet’s profile, but you may add them there, too. Rules that are not written into the description are not valid.

10. Violating these terms
Violating these terms will result in deactivating the account immediately without warning.

Bidding and Buying Agreement

1. Make a bid
A bid has to be a minimum of 0.25 PC higher than the actual price. If you make a bid that is more than 0.50 PC higher the system automatically uses the bidding agent.
A bid you made is binding. That means that you aren't able to cancel the bid after you made it. If you have questions about the pet, ask the seller before you bid. The bid is subtracted from your deposit immediately. If you are overbidden by another member, you get the amount back to your deposit.

2. The Bidding Agent
The Bidding Agent automatically raises the actual price by 0.25 PC when someone else overbids until it has reached the by the member given price. A price given to the Bidding Agent is binding. The amount of PC you set in the bidding agent is subtracted from your deposit immediately. If you win the auction with a lower amount, you get the difference back to your deposit. If someone overbids the value you set in the Bidding Agent, you get the amount you set back to your deposit.

3. Questions to the Seller
You can reach the seller by clicking on the "Ask the Seller" link in the detail screen of the pet. The e-mail address of the seller is not public. The buyer only gets his e-mail address when he gets an answer from the seller.

4. Won Auctions
When you have won an auction - congratulations. You have now 6 days to download the file from the server before it is automatically deleted.

AdBuy Agreements

1. General
With AdBuy we provide you a link to our system with which you can advertise your auctions to others on public websites like own websites or forums.
There are 2 types of AdBuy Links:
- a link to a specific auction which expires when the auction is over
- a link to all of your auctions that never expires and shows all of your running auctions everytime

2. Usage
You are allowed to use both of the links on public websites for advertising your auctions. You are not allowed to use links from other members on public sites without the permission of the specific member.

3. Violation
Violating these agreements can cause in an immediate deactivation of your member account.

Service Agreements

- We will take this website offline for the rest of a month, if the bandwidth exceeds our bandwidth limits.

- We can take this website offline, if it causes too much abusing or trouble.

- We could take this website offline, without a specific reason at any time.
